Understanding your Power of Attorney options

Lasting Power of Attorney (LPA)

There are two types of LPA, and you can set up either or both:

Property and Financial Affairs LPA allows your chosen attorney to manage your:

  • Bank accounts and investments
  • Property and assets
  • Bills and regular payments
  • Tax affairs

This can be used immediately with your permission, or only if you lose mental capacity.

Health and Welfare LPA gives your attorney authority to make decisions about your:

  • Medical care
  • Daily routine
  • Living arrangements
  • Life-sustaining treatment (if you choose)

This only takes effect if you lose the capacity to make these decisions yourself.

Making your Power of Attorney

The process is straightforward when you have the right guidance:

  1. We’ll help you choose suitable attorneys (up to four) and decide how they should work together
  2. Your document will be properly witnessed and certified
  3. Our private client team handle the registration with the Office of the Public Guardian
  4. You’ll have peace of mind knowing your wishes will be respected

Planning ahead: Why act now?

Creating a Power of Attorney whilst you have capacity prevents difficulties later. Without one, your family may need to apply to the Court of Protection to help manage your affairs – a process that’s typically:

  • More expensive
  • Time-consuming
  • Stressful for loved ones
  • Less certain in outcome

Additional options

General Power of Attorney for temporary situations, like extended travel abroad, we can set up a short-term power of attorney. This gives someone authority to handle specific tasks for a limited time.
