Community Care

Care assessments. Better outcomes.

Navigating care decisions shouldn’t feel overwhelming. When you or a loved one needs support from social services or the NHS, our community care team understands the challenges you’re facing.

We guide families through funding disputes, care assessments and safeguarding concerns with the expertise that comes from nearly 300 years of helping people protect what matters most.

What is community care?

Community care refers to services provided by a local authority (social services) and the NHS (health care services).

The services are aimed at helping an individual with their care needs – be this care at home, residential care in a care home or nursing home, or another setting. It also involves the decisions that need to be made – what care environment is most appropriate for an individual, what level of care does a person need and how will this care be paid for.

How can Morr & Co help you?

Sometimes there are issues with the services provided, or the decisions made. Our team can assist with a variety of aspects of community care law, including:

  • Obtaining suitable packages for care at home or in a care home. Further information about how to access social care services can be accessed here
  • NHS continuing healthcare funding – general advice and appealing decisions against eligibility. You can find more information about this here
  • Advice relating to funding under section 117 of the Mental Health Act – often referred to as “section 117 aftercare”
  • Top ups towards the cost of a person’s care
  • Safeguarding referrals to the local authority in respect of concerns relating to a person’s health and welfare. Find out more about safeguarding referrals here
  • Advice to attorneys and deputies in respect of their duties and responsibilities
  • Deferred payment agreements to secure funding of care fees against a person’s property
  • Advice relating to local authority financial assessments, including the treatment of a property and other assets in respect of a person’s liability to contribute towards the cost of their care. You can find more information about the financial assessment process here
  • Allegations of deprivation of assets – retrospective and future

Who can we help?

Our community care team can advise:

  • The person who is in receipt of care services, or for whom care services are proposed. This person is often referred to as the “service user” by social services and the NHS
  • Family members of a service user
  • Someone who is caring for a service user
  • Attorneys or deputies acting for the service user

Why instruct Morr & Co’s community care specialists?

Our team of solicitors are sensitive towards the stress and upset that community care issues can cause to a person and their family. Our aim is to try and take the worry away from you, providing you with clear advice and supporting you through the process.

Many of our team are Dementia Friends and members of the Association of Lifetime Lawyers (an organisation supporting older and vulnerable people with access to legal advice) – this provides us with specialist skills and knowledge to support all manner of vulnerable clients.

Our team are also Court of Protection experts, advising deputies and attorneys on their role and responsibilities in managing a person’s property and affairs. There is often a cross-over with community care and a person’s finances, our experience in both fields allows us to provide comprehensive advice to ensure a person’s health and welfare and their property and finances are both safeguarded.

We can also assist with the appointment of attorneys under a lasting power of attorney (both for health and welfare and property and finances) and applications to the Court of Protection for the appointment of a property and affairs deputy.
