Restrictive Covenants/Post-Termination Restrictions
Employers often include post-termination restrictive covenants in contracts of employment. These are clauses designed to protect the employer’s business such as its client base from departing employees, and its confidential information. Defending such proceedings, which are usually claims for an injunction and/or damages, can be costly. If you lose you may be liable for the other parties’ costs too.
